These Terms form a binding agreement between you and Tibbits Consulting Inc. (“we”). By downloading or using Kiss Map (the “App”), you agree to these Terms.
1. Eligibility & Accounts
You must be at least 13 years old and capable of forming a binding contract. You are responsible for your account credentials and any activity under your account.
2. License & Use
We grant you a limited, revocable, non‑exclusive, non‑transferable license to install and use the App for personal, non‑commercial use. You may not copy, modify, reverse engineer, or redistribute the App except as permitted by law.
3. Couple Join Codes
You may create a couple and share a join code with your partner. You are responsible for keeping join codes private and sharing them only with the intended partner. We may invalidate codes that appear compromised or misused.
4. User Content & Permissions
You retain ownership of content you submit (e.g., kiss entries). You grant us a limited license to host, process, and display your content solely to operate the App (including syncing across your devices and your couple’s devices). You are responsible for the accuracy and legality of your content.
5. Location and Safety
The App uses device location only when you choose to drop a kiss and grant permission. Do not use the App while driving or in unsafe situations. Location and place names are provided by third‑party services and may be inaccurate. The App is not an emergency service and should not be relied upon for safety‑critical purposes.
6. Acceptable Use
You agree not to:
• violate laws or rights of others;
• stalk, harass, or abuse any person;
• attempt to access data of couples you do not belong to;
• interfere with or disrupt the App or its servers;
• circumvent security, rate limits, or access controls;
• upload malware or conduct security testing without permission.
7. Third‑Party Services
Maps, geocoding, hosting, authentication, analytics, and updates are provided by third parties (e.g., Google Maps Platform, Supabase, Expo, Sentry). Your use of those features is subject to their terms and policies, and we are not responsible for their services.
8. Premium Features & Payments
We may offer premium features or in‑app purchases in the future. Additional terms may apply. Taxes may be added where required.
9. Intellectual Property
The App, its code, design, and trademarks are owned by us or our licensors. All rights not expressly granted are reserved. Google Maps data and UI elements are the property of Google and used under license.
10. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. We do not warrant that the App will be uninterrupted, error‑free, or accurate.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF CAD $50 OR THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.
13. Termination
You may stop using the App at any time. We may suspend or terminate access for violations of these Terms or to protect the App or its users. Upon termination, sections that by their nature should survive (e.g., IP, disclaimers, liability limits) will survive.
14. Changes to the Terms
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the App.
15. Governing Law & Venue
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada, without regard to conflict‑of‑law principles. Exclusive jurisdiction and venue lie in the courts located in Halifax Regional Municipality, Nova Scotia, Canada.
